TERMS AND CONDITIONS
To make your time with Star City Limousine an enjoyable one, we ask for your cooperation with the following:
Star City Limousine will strictly enforce State and Federal Laws and will maintain a zero tolerance compliance policy that no alcoholic beverages can be consumed or used by any person not of legal drinking age. All U.S. law enforcement agencies have absolute power to stop any motor vehicle for administrative searches. If contraband is aboard, even in negligible quantities without the chauffeurs knowledge, they can seize and forfeit this vehicle to a local government agency. All law enforcement agencies are aggressively enforcing this policy. Therefore no person will bring contraband aboard vehicles that are owned or operated by Star City Limousine. Star City Limousine will not be responsible for injuries that may occur due to horse playing while the vehicle is in motion or at a standstill. The purchaser on the front of this contract is responsible for his or her guests.
AT THE CHAUFFEUR'S DISCRETION, THE PURCHASER AGREES TO BE FULLY LIABLE FOR ALL CHARGES THAT MAY INCUR.
- $ 20.00 per broken glassware
- $ 500.00 per damaged seat, $ 300.00 per damaged carpet, $ 750.00 per damaged mirror
- $ 100.00 minimum for extensive cleanup (spills, etc.)
- $ 175.00 detailing and wax (due to sickness-exterior)
- $ 250.00 shampoo and disinfecting (due to sickness interior)
- $ 400.00 minimum for each burn hole, rip or tear to upholstery
- $ 800.00 minimum for any escape hatch/roof damages
- $ 200.00 minimum for each act of vandalism
- $ 2000.00 opening a Car Door into another Vehicle or Stationary Object
- Triple charge of above listed amounts for all removed / stolen items from vehicle
- Downtime subject to loss of revenue, per each hour lost as stated in contract Star City Limousine recommends that all and any personal valuables be removed from the vehicle when unattended. We will not be held responsible for any lost, stolen, or damaged articles
Star City Limousine reserves the right to terminate this or any other contract for noncompliance of the above requests, especially if renters do not follow chauffeurs requests in order to obey the rules in this contract. No smoking is allowed in our vehicles. Any deposits (cash, checks or credit card authorization) will be non-refundable for any reason, if any cancellation occurs from renter's side. Deposits are charged on the credit card you provide with this contract. All prices are quoted for cash only and taxes are applicable with all credit card or cash transactions along with the 3% credit card service charge so balance due amounts above may by slightly off. The open balance is due immediately at the beginning of the agreed job. The renter authorizes the immediate 30% non-refundable deposit & the final payment, states that she/he is the authorized purchaser for this rental contract, the authorized cardholder for the given credit card, responsible and liable for payment of the total amount, per cash, credit card or money order. No personal or business checks will be accepted. Reservation can be postponed to another date based on availability and deposit can be used for up to 6 months from original date with no exceptions.
As with all contracts, the rental contract between the mentioned person as renter and Star City Limousine INC is made with the information and the terms given to us. All of the given information from the renter is binding and cannot be changed without Star City Limousine acceptance. If the contract is cancelled or accepted after it is signed, Star City Limousine is still authorized to collect the remaining balance in full, if the car was not re-rented again on the cancelled date for the same or higher amount. We will reserve the said date upon the approval of the purchaser's credit card as per telephone conversation. The credit card holder gives authorization to use the credit card information over the phone / fax / internet in combination with a signed contract. The credit card will be authorized before dispatching limousine.It is agreed that it is not necessary to obtain a signed credit card slip, as the reservation is made over the phone / fax / internet. Proof of identity of the purchaser using said credit card must be supported by the signed contract / credit card authorization via fax or in person. At time of pickup we need the credit card, state identification of the purchaser that authorizes the transaction for the signed contract. If the purchaser cannot provide all of the above items at the time of pickup, Star City Limousine will not start the job, as we have no proof of the legal possession of the credit card. Therefore the risk of not getting paid will give us the right to cancel. The purchaser is still fully responsible to pay the total amount as he failed to provide the above requirements.
Star City Limousine rates are billed, including, applicable fees / taxes and a 20% administrative charge. If you feel that you would like to provide gratuity to the Chauffeur based on his service it is at your sole discretion.
Any limousine over 14 passenger have to follow DOT regulations and cannot get on certain roads/parkways. The driver will follow shortest and most direct route obeying all traffic and weight regulations and will avoid traffic based on the information from gps and internet sources. Please allow additional time when booking DOT vehicles. If the customer requires to take specific route to the destination it has to be submitted beforehand and updated on the reservation form with no exception. All stops and pickups must be provided on the reservation form and it is not company or driver responsibility for any delays caused by changes or lack of information on the reservation form. Star City Limousine cannot guarantee the availability of overtime. We are not responsible for lost/not received confirmations when booking via internet. Some clients have spam blockers on and sometimes confirmations don't get through. It's customer's responsibility to call and get a confirmation number. It is of particular importance that the purchaser makes allowances for anticipated delays and adheres to the agreed time schedule. In the event that the purchaser wants to change the time of the itinerary, they may do so, only if Star City Limousine can accommodate other clients that booked with Star City Limousine prior to or after the said time. The purchaser further agrees to pay additional charges incurred such as overtime, tolls, parking, travelling time etc. Contracted price is set for contracted pickups, addresses, time and number of passengers. If the customer choose to change vehicle to different one we will do our best to accomodate the change and the original contracted price will remain the same and no refunds will be given if the customer choose to downgrade rented vehicle or choose the vehicle with lesser rental value. Any additional stops that are not in the confirmed reservation will be charged as point-to-point transfer. As indicated in the contract, any extra passengers traveling in the vehicle are subject to extra charge. SUV limousine specials for $99/hour is only applicable for weekdays (Mon-Thu) and for 5 boroughs, additional charges or higher rate (minimum $125/hr) will be charged on weekends or for pickups outside of 5 boroughs. $99/hour specials cannot be used for wedding service under any circumstances. Contracted hours cannot be changed without prior approval from the office and cannot be amended once the job is started.
Overtime for airport jobs is charged in 30 minute increments, extra stops are charged $20 - $40. If customer fails to show at designated pick up location (NO SHOW), the full amount of contracted time will be charged. On all reservations you will be considered a no-show at 30 minutes (1 hr for Intl. Arrivals requiring Customs Clearance) past your scheduled pick-up time; if you have not met your Chauffeur or contacted us by phone, you will be charged in full for the reservation. SUV AIRPORT PICKUPS: Outside Pickup ONLY. YOU MUST CALL 1 800 786 0234 to be picked up. Upon your arrival you have to go to the nearest phone booth and call our toll free # and let us know that you are ready to be picked up. Come outside to the curb side and wait about 5-8 minutes for the limo to pull up. Please DO NOT leave the airport before contacting as you will be charged NO SHOW fee. We track arrival time with most of the airlines. Some airlines don't have automated arrival system in which case we can not track the flight. If we can track the flight, we send the driver accordingly to the scheduled arrival time. We are not responsible for any flight time changes accrued once the driver gets to the airport. In that case waiting time is applied while the driver waits for the delayed passenger to come in. To avoid being charged as a no-show, do not leave your location without contacting Star City Limousine by phone. On all the Point to Point transfers Star City Limousine provides up to a 10 minute grace period at pick-up; before wait time charges apply at the hourly rate of the vehicle + 20% administrative charge billed in 1 hour increments (1 hour for 14 - 20 pass limousines). Point to Point Transfers include all Airport Transfers, Cruise Port Transfers, Point A to Point B Transfers and all non hourly reservations. Overtime for hourly rentals starts after 10 minute grace period and is billed in 1 hour increments.
The purchaser authorizes Star City Limousine to charge any additional charges after they have rendered services to the purchasers credit card as supplemental charge. A 20% administrative charge will be added to your total charge as well as 3% credit card service surcharge and 5% fuel surcharge. If cash payment is selected, the payment is due at the beginning of the rental time. Customer agrees to have Star City Limousine get an authorization for the above credit card and amount, for the event stated above.
Star City Limousine are not responsible for items that are left in the vehicle, lost or damaged. Star City Limousine reserves the right to charge a delivery fee for returning lost items if found. Star City Limousine is not responsible for traffic encountered during vehicle rental time and any delays caused by directions instructed to the driver by passengers. The rate will be equal to the rate of an Airport Transfer to your location. Star City Limousine Chauffeur's will assist with luggage at a client's request, but assume no liability for doing so.
Cancellations will be charged a cancellation fee of $150.00-Lincoln / 30% or $250.00 minimum for SUV . Cancellations made within less than 48-hrs will be charged a full price of the booked ride. Same rules apply even if the job is booked within 48-hrs of service. All cancellations have to be submitted in writing and they have to be confirmed with a cancellation confirmation number. In rare cases we allow 3-months grace period to use the deposit towards other reservation and it is at company's discretion. Prom reservations are not confirmed until reservation is submitted and deposit is collected with no exceptions. Deposit for prom is minimum $500 with no exceptions.
Prom reservation rules: Once you fill out the reservation it can not be cancelled. If you don't feel like you would like to use our services we keep the 30% deposit. Cancellations made within 2 months will not be responsible for the remaining balance. Any contracts cancelled within less than 2 months will be responsible for the full amount of the balance due. If any payment due hereunder will be unpaid (10) ten days after the due date, hereon Star City Limousine will have the right to add and collect late charges with interest at maximum rate allowed by law. All such sums are due and owing with any other expenses, (filing fees, court cost, and reasonable attorney fees, etc.). Necessarily injuries by reason of such non-payments, I the credit card holder / purchaser agree to pay Star City Limousine upon signing of this contract. All of the given information from the renter is binding and cannot be changed without Star City Limousine acceptance. If the reservation is cancelled or accepted after it is signed, Star City Limousine is still authorized to collect the remaining balance in full, if the car was not re-rented again on the cancelled date for the same or higher amount. The credit card holder gives authorization to use the credit card information over the fax /internet in combination with electronic reservation for the Deposit and the remaining balance. It is agreed that it is not necessary to obtain a signed credit card slip, as the reservation is made over the fax /internet. If the purchaser doesn't pay the full amount of the balance, Star City Limousine will not start the job. Therefore the risk of not getting paid will give us the right to cancel. The purchaser is still fully responsible to pay the total amount as he failed to provide the above requirements. We allow a discretionary amount of mileage on prom night. This means you may either go into NYC after your prom or stay in the local area (Nassau County & Western Suffolk County). If you would like to go to the Hamptons, New Jersey, or the Poconos, there will be an additional charge.This charge is separate and is not included in the total amount of the contract. If you want to do both NYC and the Hamptons, N.J. or the Poconos, you will be charged separately and accordingly. All tolls are additional to the total amount of the contract as well. Sorry, there are no exceptions. The purchaser further agrees to pay additional charges incurred such as overtime, tolls, parking etc. Star City Limousine allows up to 4 pickups / 4 drop offs (excluding a stop for a prom and after prom). Any additional stops - $25/Sedan or $50/SUV per stop. If you wish to have unlimited stops there is an extra $350 charge ' please ask the representative. All prom hourly packages are Garage - to - Garage based. Car leaves from the garage at the beginning of the hourly package and it has to be back to the garage at the end of the hourly package. Once the vehicle picks all students up it goes to the prom location. Vehicle stays at the prom location while students are at the prom (there is no riding around for students not even to the store, etc.). After the prom, vehicle can make up to 2 stops before it starts making drop offs. Each additional stop will be $25/Sedan or $50/SUV extra per stop. There is no breaking apart of the group for the After-Prom Party. Vehicle stays where the majority of the group got off for the stop. There is no riding around to other locations while most of the group got off at the stop. As with all contracts, the rental contract between the mentioned person as renter and Star City Limousine is made with the information and the terms given to us. Contracted price is set for contracted pickups, addresses, time and number of passengers. As indicated in the contract, any extra unaccounted passengers traveling in the vehicle are subject to extra charge. There are no downgrades of the vehicles (only upgrades).
If any payment due hereunder will be unpaid (10) ten days after the due date, hereon Star City Limousine will have the right to add and collect late charges with interest at maximum rate allowed by law. All such sums are due and owing with any other expenses, (filing fees, court cost, and reasonable attorney fees, etc.). Necessarily injuries by reason of such non-payments, I the credit card holder / purchaser agree to pay Star City Limousine upon signing of this contract. I am satisfied with the terms and conditions above and fully understand and agree. If, for any reasons, I am not fully satisfied with the services I receive, I have 10 hours after the completion of the job to file a complaint in writing. If Star City Limousine does not receive my written complaint in the above stated timeframe, I agree, that there is no valid complaint and I am fully satisfied with the services I received. Filing a written complaint, insures both parties, that it is fully understood what the problem was, and should help Star City Limousine to assist the purchaser in any kind of reimbursement. The purchaser will be contacted within a week of the complaint to settle the matter. I understand that this is a separate case from the main contract and therefore have no dispute in general against Star City Limousine and the payment I authorized.
Since Star City Limousine offers high-tech-equipped vehicles, sometimes heat and excessive use of all power-operated equipment might be subject to temporary failure. This will of course not interfere with the safety of the vehicle itself and therefore will have no effect on continuing or paying of the contracted trip. Star City Limousine guarantees, that all our vehicles are constantly checked to keep the highest possible standards and eliminate such failures as much as possible. The limousines equipped with IPOD connectors are subject to compatibility issues, please make sure you have latest iOS on your device as we cannot gurantee that your device will work and cannot be liable for such issues. Star City Limousine agrees to send the requested vehicle as offered in the contract. We have the right to upgrade the vehicles or switch the vehicles in case of emergency breakdown or if vehicles were in accidents. As stated, this will only happen in emergencies, and to upgrade, never downgrade. If no upgrade is available, Star City Limousine gives the customer the right to downsize the vehicle and receive additional discounts if wanted. No additional charges will occur on customer side if upgrade is made without customer request. If switching occurs in the same category, or upgrades are made, it will not affect the contract and / or payment of contract. Customer's therefore accepts that replacement limousine may be substituted if contracted limousine becomes unavailable for any reason.
If any of our above guarantees or contracted terms cannot be met due to conditions outside of our control, including weather, accidents and any other acts of god, including, but not limited to traffic congestion, road closures, accidents, flight delays, weather delays, road closures etc., we will use our best efforts to notify the customer of these conditions and resulting delays or changes. Star City Limousine reserves the right to terminate any reservation without refund, if the Operator or the Dispatcher on duty feels that the Renter and /or Party of the Renter is putting the Operator or the mode of transportation or the Renter/and/or Party of the Renter in danger of injury. Or, if the Renter and/or Party of the Renter are in the possession of any illegal material and/or substance, this service will be canceled without refund. This is without exception.
For any goods sold: We do not accept returns or exchanges unless the item you purchased is defective. If You receive a defective item, please contact us via email with details of the product and the defect within 14 days with pictures of the problem. We will issue RMA and provide instruction for the return. Returns without RMA will not be accepted. Upon receipt of the returned product, we will fully examine it and notify you via e-mail, within 7 days, whether you are entitled to a refund or a replacement as a result of the defect. If you are entitled to a replacement or refund , we will replace the product or refund purchase price, using the original method of payment. Refunds do not include any shipping or handling charges show on the packaging slip or invoice. Shipping charges for all returns must be prepaid and insured by you. You are responsible for any loss or damage to item during shipment. Absolutely no returns will be accepted without RMA or after 14 days of the date of delivery.
By pressing "I Accept" Button, I'm providing a legal signature(s) electronically and authorize Star City Limousine to honor Electronic Signature(s). As such, I assume full responsibility for any and all payments, services etc., made by Star City Limousine in reliance upon the Electronic Signature(s). I agree to hold Star City Limousine harmless for any and all losses or illegal charges I or any other person or entity may suffer, including all expenses incurred, without limitation attorney's fees, arising out of misuse or unlawful or unauthorized use of such actual or purported e-signature(s).
